Terms of Use

1. Nature of the service

Nischaya is an online matchmaking facilitation platform — a digital replacement for traditional matrimonial classifieds. We provide tools to create and promote a matrimonial profile, discover other members, compute compatibility information, and communicate. The Platform is an intermediary under the Information Technology Act, 2000: profiles and messages are created by members, not by us.

The exchange of a profile, a match suggestion, or a compatibility score is not a matrimonial offer, endorsement, or recommendation by Nischaya. Any decision to pursue or enter a matrimonial alliance is solely yours.

2. Eligibility

You may register only if you meet all of the following conditions:

• You are a natural person (not a company, partnership, agency, or any other legal entity).
• You are of legal marriageable age under the laws of India — currently 18 years or above for women and 21 years or above for men — and legally competent to contract.
• You are not prohibited or restrained from entering into matrimony by any law, or by any order, decree, or injunction of a court, tribunal, or competent authority.
• You register with the bona fide intention of seeking a life partner. The Platform is not for casual dating, companionship, commercial solicitation, or any immoral, illegal, or exploitative purpose.
• If you create a profile on behalf of another person (for example, a parent for a child), you confirm that you have that person's knowledge and consent, and you agree to provide proof of that authorisation if we ask for it.

3. Your account

You must verify your mobile number to activate a profile. You are responsible for the confidentiality of your credentials and for all activity under your account.

Each individual may maintain only one profile. We may deactivate duplicate profiles without refund. You may not impersonate any person, misrepresent your identity or marital status, or create a profile for any organisation.

We may ask you at any time to produce documentary evidence supporting information on your profile (identity, education, employment, marital status). Failure to produce satisfactory evidence may result in suspension or termination without refund.

4. Member conduct

You agree that you will not:

• Harass, abuse, threaten, or harm another member, online or offline, including using information obtained through the Platform.
• Solicit money, gifts, loans, or financial information from other members, or engage in any fraudulent scheme. No genuine match will ever ask you for money or an OTP.
• Post content that is false, misleading, defamatory, obscene, infringing, invasive of another's privacy, or otherwise unlawful.
• Advertise or solicit any product, service, or business; post external promotional links; or use the Platform for data harvesting, lead generation, or recruitment.
• Attempt to copy, scrape, or bulk-download profiles or other Platform content, or interfere with the Platform's operation or security.

5. Communications consent

By registering, you consent to receive service communications from Nischaya — OTPs, verification calls, match notifications, membership updates, and promotional messages — via SMS, WhatsApp, email, and calls, for as long as your account is active. This consent overrides any preference registered on the Do-Not-Disturb (DND) / National Customer Preference Register (NCPR) to the extent permitted by law.

You may withdraw consent for promotional communication at any time from Settings → Notifications, or by deactivating your account. Essential service messages (such as OTPs) cannot be opted out of while your account remains active.

6. Content and intellectual property

You retain ownership of the content you submit (photos, text, horoscope details). By posting content, you grant Nischaya a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, adapt, and display that content to other members in accordance with your privacy settings, and to operate, promote, and improve the Platform. Photos may be watermarked to deter misuse.

All Platform software, design, trademarks, and compilations are the property of Nischaya or its licensors. We grant you a limited, personal, non-transferable, revocable licence to use the Platform for its intended matrimonial purpose only. This licence ends automatically on termination of your account or any breach of this Agreement.

We reserve the right to review, screen, edit, or remove any content that violates this Agreement, is unlawful, or threatens the safety or reputation of members or the Platform, without refund or compensation.

7. Membership and payments

Paid memberships are billed in advance for the selected duration, are personal to you, and are non-transferable. Features at each tier are described on the Pricing page and may change with reasonable notice; changes do not reduce features you have already paid for during an active period.

Prices are inclusive of applicable GST unless stated otherwise. Payments are processed by PCI-DSS compliant payment gateways; we do not store your full card details.

Refunds and cancellations are governed exclusively by our Refund & Cancellation Policy, including the 30-day money-back guarantee for first-time premium members. Termination for breach of this Agreement does not entitle you to any refund.

8. Partner services

The Platform hosts independent third parties: wedding vendors (Vendor Terms apply), panel astrologers (Astrologer Panel Terms apply), and counselors. These partners are independent contractors, not employees or agents of Nischaya.

Counseling and astrologer consultations are guidance services. They do not constitute medical, psychological, psychiatric, or legal advice, and astrological readings are a matter of tradition and belief — informational, not predictive fact. Contracts, payments, and outcomes between you and a vendor are solely between you and that vendor.

9. Disclaimers

The Platform is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, Nischaya disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.

Match suggestions and compatibility scores (including the 36-guna score) are generated algorithmically from profile inputs and are intended solely for your personal consideration. We do not guarantee any match, marriage, or relationship outcome.

Verification badges mean a member completed our verification process at a point in time — they are not a guarantee of character or conduct. You are strongly advised to independently verify any information provided by another member, including blue-tick profiles, before making any decision, and to follow the guidance in our Safety Center.

10. Intermediary compliance and law enforcement

As an intermediary under the IT Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we do not knowingly host unlawful content and will disable access to such content upon gaining actual knowledge or upon a lawful order.

We cooperate with police, cyber-crime cells, and statutory authorities in investigating fraudulent or unlawful activity on the Platform, where specifically instructed by such authorities, in accordance with applicable law.

11. Termination

You may terminate your membership at any time from Settings → Account, or by writing to us. Except as stated in the Refund & Cancellation Policy, termination by you does not entitle you to a refund of unused fees.

We may suspend or terminate your account, with or without notice, for breach of this Agreement, for unlawful or non-matrimonial use, or to protect members or the Platform. Provisions on intellectual property, disclaimers, limitation of liability, grievance, and governing law survive termination.

12. Limitation of liability

To the fullest extent permitted by law, Nischaya is not liable for indirect, incidental, special, or consequential damages — including loss arising from interactions or relationships with other members, online or offline, or from dealings with vendors, astrologers, or counselors.

Our aggregate liability for direct damages arising from paid services shall not exceed the membership fees you paid in the twelve months preceding the claim. Nothing in this section limits liability that cannot be limited under applicable law, including the Consumer Protection Act, 2019.

13. Grievance redressal

In accordance with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer:

• Complaints are acknowledged within 24 hours and resolved within 15 days.

14. Governing law and changes

This Agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, without prejudice to your statutory rights as a consumer.

We may update this Agreement from time to time. Material changes will be notified on the Platform and, where required, by email, before they take effect. Continued use after the effective date constitutes acceptance.
